Terms of Use

1. Purpose
These Terms of Use govern access to and use of the wazaap.be website and the Wazaap SaaS solution, published by BSIDE SRL.
2. Access to Service
The website is freely accessible. Access to the Wazaap platform requires creating a professional account and is reserved exclusively for B2B use.
3. User Account
The user agrees to provide accurate information and maintain the confidentiality of their credentials. Any action performed from an account is deemed to have been carried out by the account holder.
4. Acceptable Use
It is strictly forbidden to use Wazaap for:
- any illegal activity or activity contrary to regulations,
- infringing the rights of third parties,
- compromising the security, integrity or availability of the service,
- introducing malicious or fraudulent content.
BSIDE SRL reserves the right to suspend or terminate an account in case of breach.
5. Intellectual Property
Wazaap is protected by intellectual property law. No ownership rights are transferred to the user. The user only receives a limited, non-exclusive and non-transferable right of use.
6. User Data
The user remains solely responsible for and owner of the data they process via Wazaap and guarantees their legal compliance, particularly with regard to GDPR.
7. Availability
BSIDE SRL aims for high service availability, without guaranteeing complete absence of interruption (maintenance, updates, technical incidents).
8. Limitation of Liability
To the extent permitted by law, BSIDE SRL cannot be held liable for indirect damages, such as loss of revenue, data loss or commercial prejudice.
9. Applicable Law
These Terms of Use are subject to Belgian law. Any dispute falls under the exclusive jurisdiction of Belgian courts.
Terms of Sale

1. Purpose
These Terms of Sale govern the conditions for subscribing to and using subscriptions to the Wazaap SaaS solution, exclusively intended for professional clients (B2B).
2. Offers and Orders
Offers, features and prices are described on the wazaap.be website. Any subscription constitutes unreserved acceptance of these Terms of Sale.
3. Prices and Payment
Prices are expressed in euros, excluding VAT. Payments are processed by a secure payment provider compliant with current standards. BSIDE SRL does not store any banking data.
4. Duration - Renewal
Subscriptions are concluded for a fixed period (monthly or annual) and automatically renewed, unless terminated in accordance with Article 5.
5. Termination
Termination must be requested by email to contact@wazaap.be, at least three (3) months before the subscription renewal date.
Any late termination will result in renewal of the subscription for the following period.
6. Liability
BSIDE SRL's liability is strictly limited to the total amount actually paid by the customer for the subscription during the current contractual period, unless mandatory legal provisions provide otherwise.
7. Applicable Law
These Terms of Sale are subject to Belgian law. BSIDE's Terms of Sale also apply in addition to the 7 articles above.
Privacy Policy (GDPR)

When the solution is used by client companies, the employer acts as the data controller, and BSIDE acts as the data processor, in accordance with Article 28 of the GDPR.
2. Data Collected
In the context of using the solution, the following data may be processed:
- Identification data: last name, first name, employee number
- Professional data: job title, company, team
- Time-tracking data: clock-in and clock-out times, breaks, travel, …
- Absence data: leave, authorised absences, …
- Data related to sick leave (absence status only)
- Photos taken on site (if the feature is enabled)
- Technical data: connection logs, IP address, device identifier
No private data that is irrelevant to working time management is collected.
3. Purposes of Processing
Data is processed solely for the following purposes:
- Working time management
- Absence and leave management
- Compliance with social and legal obligations
- Justification of work performed
- Proof of execution in the event of a social inspection
- Site security (if photos are enabled)
Data is never used for commercial purposes.
4. Legal Basis for Processing
Processing is based on:
- The performance of the employment contract
- Legal obligations under social and tax law
- The legitimate interest of the employer in organising and managing work
With regard to sick leave data, processing is based on obligations under labour law.
5. Retention Period
Data is retained for the period strictly necessary to meet applicable legal obligations.
In particular:
- Time-tracking and working time data is retained for up to 5 years, in accordance with social and tax audit obligations.
- Absence data is retained in accordance with applicable social obligations.
- Technical data (logs) is retained for a limited period necessary for system security.
Upon expiry of the legal retention periods, data is deleted or anonymised.
6. Rights of Data Subjects
In accordance with the GDPR, employees have the following rights:
- Right of access to their data
- Right to rectification
- Right to restriction of processing
- Right to object (within legal limits)
- Right to data portability where applicable
The right to erasure may be limited where the retention of data is necessary to comply with a legal obligation or to defend rights in legal proceedings.
Requests must be addressed to the employer, as the data controller.
7. Data Security
BSIDE implements appropriate technical and organisational measures to ensure the security of data:
- Secure hosting within the European Union
- Strict access management
- Access logging
- Secure backups
- Automated retention and deletion policy
8. Sub-processors
In the context of service delivery, certain technical service providers (hosting, maintenance, cloud infrastructure) may be involved.
These providers are contractually bound to comply with GDPR obligations.
9. Transfers Outside the European Union
Data is hosted within the European Union.
In the event of a transfer outside the EU, appropriate safeguards will be put in place in accordance with the requirements of the GDPR (standard contractual clauses or equivalent mechanisms).
